Frequently Asked Questions

Do we each find our own mediator?
No. One mediator is hired and should be agreeable to all parties.

Should my mediator be an attorney?
Attorneys provide legal advice. When an attorney is acting as a mediator they are not allowed to offer legal advice. During the session, if need for legal advice arises, plans can be made to seek out information. Quite often mediators who come from backgrounds other than the law charge less per hour.

Who pays?
The fee is often split between participants.

Who should come to the mediation?
The mediator will help you decide. Group size varies. Resource people are sometimes included via conference calls.

What if I don’t want to be in the same room with the other person?
Two rooms can be made available.
